Acceptable Use Policy (AUP) for OneMind Services

OneMind Services is committed to providing our customers with a wide range of services, including cloud hosting, virtual private servers (VPS), dedicated servers, and managed IT services. We strive to maintain a secure and reliable environment for all users. To ensure the continued quality and integrity of our services, we outline the following Acceptable Use Policy (AUP).

By using OneMind Services, you acknowledge and agree to comply with this policy. OneMind Services reserves the right to terminate or restrict any user’s account if it is found in violation of this AUP. This policy may be revised at any time, and continued use of OneMind Services constitutes acceptance of the revised terms.

Definitions

You, Customer, Client, Subscriber, and User refer to the individual or entity utilizing OneMind Services.

Personal Files

OneMind Services is not responsible for backing up user data unless specifically contracted to do so. We reserve the right to delete information related to user accounts after a reasonable period if the user discontinues services with us.

Domain Registration Fees

Domain registration fees are nonrefundable after five (5) days from registration. If a refund request is made within the first five days, a ____ processing fee will apply.

Network IP Address Assignments

Any IP addresses issued by OneMind Services remain the property of OneMind Services and are temporarily loaned to the client. If service is terminated, these IP addresses will revert to OneMind Services.

No Warranties

OneMind Services makes no warranties of any kind, express or implied, for the services it provides. This includes any implied warranty of merchantability or fitness for a particular purpose. OneMind Services is not responsible for any damage resulting from service interruptions, delays, or errors, whether caused by us, our clients, or third parties.

Contact Information

It is the user's responsibility to provide and maintain accurate contact information, including email addresses and phone numbers, with OneMind Services. Users must monitor their primary email for communication from OneMind Services.

Taxes

Users are responsible for all taxes and fees applicable to their purchases and services provided by OneMind Services.

Termination

Termination requests can be made by phone or email. OneMind Services can be contacted 24/7 at support@onemindservices.in All service terminations will require account verification for security purposes.

Cloud service Limitations

Users are prohibited from using OneMind Services for activities such as:

Open proxies
CDN services
Torrenting
Cryptocurrency mining
IRC bots
Reselling services

Prohibited Activities

To maintain a safe and reliable service, the following activities are strictly prohibited:

Obscene Materials/Speech: Child pornography and similar materials are prohibited. Any violations will result in immediate termination and legal reporting.
Spamming: Sending unsolicited bulk or commercial messages is prohibited.
Intellectual Property Violations: Activities that infringe upon intellectual property rights, including software piracy and unauthorized use of copyrighted materials, are prohibited.
Licensing Violations: Users must comply with all applicable software licensing laws, including for Microsoft products and other third-party software.

High-Risk Use

OneMind Services' offerings are not designed for high-risk applications or environments that require fail-safe performance, such as nuclear facilities, life-support systems, or aircraft navigation systems.

Defamatory/Abusive Language

Harassment, abusive language, and threats made through OneMind Services' network are prohibited.

Illegal or Unauthorized Access

Unauthorized access to other networks or systems is prohibited. This includes attempting to penetrate security measures or conducting port scanning.

Facilitating Violations

Advertising, distributing, or using software designed to breach this AUP will result in immediate action, including account suspension or termination.

Third-Party Subscribers

Users who act as resellers or ISPs are responsible for ensuring their subscribers adhere to this AUP. Violations by third-party users may result in restrictions on the reseller's account.

Privacy

OneMind Services respects user privacy but may disclose user information to comply with legal or regulatory obligations, such as court orders or subpoenas.

Right to Damages

If a user violates this AUP and causes economic damage to OneMind Services, we reserve the right to seek compensation for any resulting losses.

Indemnification

Users agree to defend, indemnify, and hold OneMind Services harmless from any claims, losses, or liabilities arising from their actions or use of our services, including third-party claims related to copyright infringement or other violations.
